SPEAKER’S DECISION NOT TO ALLOW MP’S WHOSE SEATS ARE NULLIFIED WELCOMED

Social and Political Anthropologist Dr. James Musonda has charged that the decision by the Speaker of the National Assembly to declare that Members of Parliament whose seats have been nullified should not seat in parliament is welcome.
On Tuesday, Speaker of the National Assembly Nelly Mutti ruled that Members of Parliament whose seats were nullified by the High Court cease to be MPs and must no longer continue to attend Parliament or draw salaries and emoluments in spite of them appealing in the Constitutional Court.
Dr. Musonda states that the decision represents a shift from past practices which rendered court rulings a mere academic exercise noting that in the past, MPs continued to manipulate the court processes when their seats were nullified to continue in parliament.
He adds that the Speaker’s decision also underscores the importance of the separation of powers, and the rule of law.
